What is statutory adoption pay (SAP)?

If you are adopting a child, you may be entitled to claim Statutory Adoption Pay and Leave for a period that will enable you to take time off work around the time the child is placed with you.

Leave can start:

– On the date the child starts living with the employee or up to 14 days before the expected placement date.

– The day the child is born or day after

– If possible 8 weeks’ notice to return to work following leave is recommended.

– Adoption leave lasts for up to 52 weeks.

Statutory Adoption Pay entitlement:

– 90% of your gross average weekly earnings for the first 6 weeks.

– £194.32 a week or 90% of your gross average weekly earnings (whichever is lower) for the next 33 weeks.

– If possible 8 weeks’ notice to return to work following leave is recommended.

– Your company can claim 108.5% of the SAP paid to if the company’s liability for Class 1 NIC is £45,000 of less.

NOTE – If you are not entitled to SAP, then we will supply you with a form SAP1. You cannot claim SAP & Statutory Paternity Pay for the same period.
